By accessing and using the services provided by Kids Active Fun ("we," "our," or "us"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Kids Active Fun.

Kids Active Fun provides children's amusement park services including but not limited to:

• Indoor and outdoor playground equipment and rides
• Educational activities and workshops
• Birthday party and event hosting services
• Seasonal events and special programs
• Food and beverage services
• Retail merchandise

All services are subject to availability and may be modified, suspended, or discontinued at our discretion. We reserve the right to refuse service to anyone for any reason at any time.

3. User Conduct and Responsibilities

3.1 General Conduct

All visitors must behave in a respectful and appropriate manner. The following behaviors are strictly prohibited:

• Disruptive, aggressive, or inappropriate behavior
• Use of foul language or offensive conduct
• Bringing prohibited items (weapons, alcohol, illegal substances)
• Smoking or vaping anywhere on the premises
• Damaging or vandalizing property
• Unauthorized photography or recording of other guests

3.2 Supervision Requirements

Parents and guardians are responsible for supervising their children at all times. Children under 12 must be accompanied by an adult. We provide a safe environment, but ultimate responsibility for child safety remains with the supervising adult.

4. Safety Requirements and Guidelines

4.1 Age and Height Restrictions

Certain attractions have age, height, and weight restrictions for safety purposes. These restrictions are strictly enforced and non-negotiable. Parents must ensure their children meet all requirements before participating in activities.

4.2 Health and Medical Conditions

Visitors with medical conditions, disabilities, or health concerns should inform our staff before participating in activities. We reserve the right to restrict access to certain attractions if we determine it may pose a safety risk.

4.3 Emergency Procedures

In case of emergency, all visitors must follow the instructions of our staff immediately. Emergency exits are clearly marked throughout the facility. Please familiarize yourself with evacuation procedures upon arrival.

5. Liability and Risk Assumption

5.1 Assumption of Risk

By using our facilities, you acknowledge that participation in amusement park activities involves inherent risks. While we maintain high safety standards, you assume all risks associated with your visit and participation in activities.

5.2 Limitation of Liability

To the maximum extent permitted by law, Kids Active Fun shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including but not limited to:

• Personal injury or property damage
• Loss of personal belongings
• Emotional distress or inconvenience
• Loss of enjoyment or entertainment value

5.3 Insurance

We maintain comprehensive liability insurance as required by Canadian law. However, visitors are encouraged to ensure they have adequate personal insurance coverage for medical expenses and personal property.

6. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of personal information is governed by our Privacy Policy, which forms an integral part of these Terms of Service.

By using our services, you consent to the collection and use of your information as described in our Privacy Policy. We may use photographs or videos taken on our premises for marketing purposes unless you specifically opt out.

7. Payments, Pricing, and Refunds

7.1 Pricing and Payment

All prices are displayed in Canadian dollars and include applicable taxes. Payment is required at the time of service unless otherwise arranged. We accept cash, credit cards, and debit cards.

7.2 Refund Policy

Refunds are generally not available for admission fees once you have entered the facility. However, we may provide refunds or rain checks in the following circumstances:

• Closure due to severe weather or emergency conditions
• Significant equipment failures affecting major attractions
• Other circumstances at our discretion

7.3 Gift Certificates and Passes

Gift certificates and passes are non-refundable but may be transferred to another person. Expiration dates are clearly stated and strictly enforced. Lost or stolen passes will not be replaced.

We reserve the right to modify these Terms of Service at any time. Material changes will be posted on our website and will become effective immediately upon posting. Your continued use of our services constitutes acceptance of the modified terms.
